Because our privacy policy (this “Privacy Policy”) is updated periodically, and by continuing to access our website thcspots.com (the “Site”) you are consenting to any changes, we encourage you to review this Privacy Policy on a regular basis.

Your Privacy: Overview

This Privacy Policy tells you about the information that THCSpots and its affiliates and partners collect in connection with the operation of the Site, how the information is used and how you can access and correct certain information that we may collect.

By using the Site, you agree to be bound by the terms and conditions of this Privacy Policy and the THCSpots Website Terms of Use (the “Terms”). You may also be subject to another privacy policy or other terms and conditions specific to a particular THCSpots program or service (each, an “Other Agreement”). Based upon your specific relationship(s) with THCSpots, we may collect, use or disclose your information in ways described in more detail in one or more Other Agreements. Information Collected

Your IP Address

An IP (Internet Protocol) address is automatically assigned to your computer every time you establish a connection on the Internet. THCSpots uses your IP address to help diagnose problems with our server and to administer our Site. THCSpots does not link your IP address to any identifiable personal information.

Cookies

In computer language, a cookie is used to automatically store data on your computer’s hard drive and stays on your computer until you erase it. We use cookies to store your e-mail ID on your computer so that you don’t have to re-enter it each time you visit the Site. We never use cookies to capture personal information from your computer, although your personal information may become associated with a cookie if you establish an account with us. Some of our business partners may use cookies on our Site. We have no access to or control over these cookies. The only personal information THCSpots has is the information you have provided.

Your Account

THCSpots can obtain access to your name, e-mail address and other contact information only (1) when you become an advertiser with THCSpots, provide comments, submit a problem, or request information from the Site and provide your name or return contact information, or (2) in connection with special offers or contests. Contact information provided in connection with problems, comments or requests is used only to respond to those problems, comments or requests.

Upon registration in the THCSpots account management system, advertisers are requested to provide company, contact and credit card information. This information is primarily used to identify the account and correspond to the account holder in regard to payments, credits, problems and questions. Credit card information is provided to third party credit card processors for the sole purpose of verifying that the credit card is valid and to authorize purchases or to administer refunds to cancelled accounts. Secondary uses of the information provided are to assist THCSpots staff in detecting and tracking any potential fraud.

Additional Information Collected

Any personal correspondence you send to us, including e-mail and letters, as well as correspondence from other customers or third parties about your activities or postings pertaining to THCSpots, and all entries made by you onto our Site, may be collected and stored. Any notes, ideas, suggestions, or other material submitted by users becomes the property of THCSpots. By providing such content to us, you consent to our use, modification, copying, publication, display and / or distribution of such content at no compensation or other obligation to you. You acknowledge that all such content is owned by THCSpots and is subject to our Terms, and you consent to the publication, display or distribution of such content.

THCSpots may run contests where we ask users for contact information such as e-mail or physical addresses. THCSpots may retain a third party company to oversee the collection and correct entry of user contact information. The aforementioned third party company will also supply and oversee distribution of prizes for such contests. The user information collected during the contest will not be used by the third party for any purpose other than that of running the THCSpots contest. THCSpots may use contact data to send users information about THCSpots, as well as promotional material on behalf of our partners. You may opt-out of receiving these and future mailings as outlined below.

Unsupervised Children

Children 18 and under are not eligible to use THCSpots services without the participation and supervision of a legal parent or guardian. THCSpots is not a site meant for children, and we do not provide privacy measures designed to protect children when using the Internet unsupervised.

Expunging Your Information From Our Records

You may e-mail us as described below to remove your contact information from our database, provided we have completed all your pending transactions. Please note, however, that information is never completely removed from our history and disaster recovery archives. You may access and edit your account information by logging into your account online and clicking on the “Edit Profile” link.

Use of Your Personally Identifiable Information

THCSpots uses the personally identifiable information we collect about you to provide any products or services requested by you. Upon our collection of your personally identifiable information, THCSpots may use such personally identifiable information internally, separately or in combination with pre- existing information, for the following purposes:

  • To provide any requested products or services;
  • To troubleshoot problems with the Site, or any products or services, as requested;
  • To improve our products and services, and identify, develop and offer new or expanded products and services;
  • To ask you to participate in brief surveys;
  • To generate aggregate statistical studies and conduct research related to our products and 
services and the use of our Site;

In addition, we may disclose your personally identifiable information to our subsidiaries or affiliates and to third party partners whom we occasionally hire to provide services on our behalf, including support services, website services, answering customer questions about our services and new services. THCSpots will only provide those partners with the personally identifiable information they need to deliver the services to us and/or on our behalf, and they will be contractually prohibited from using that information for any other purpose.

In the event that THCSpots is involved in a transaction such as a merger, stock purchase or sale, or sale of substantially all of THCSpots’s assets, your personally identifiable information may be transferred to the other party in such transaction.

From time to time, we may disclose aggregate de-identified information about users of the Site to service providers, partners, advertisers or others, but such information will not include personally identifiable information. Because non-personal information does not personally identify you, we may use or disclose such information for any purpose. In some instances, we may combine non-personal information with personally identifiable information (such as embedding an account’s email addresses in cookies). If we do combine any non-personal information with personally identifiable information, the combined information will be treated by us as personally identifiable information in accordance with this Privacy Policy.

Transactional Information

THCSpots transactional information such as traffic patterns, sales, aggregate data regarding general shopping patterns, and other site information may be shared with vendors and other reputable third parties. This data will never contain any identifiable personal information of THCSpots Site users. For example, we might share statistics on how many customers purchased a specific product, but we will not specifically disclose who purchased the product.

Legal Issues

THCSpots discloses personal information when required by law or in the good-faith belief that such action is necessary for the following:

  • To conform to the edict of the law or comply with a legal process served on THCSpots or the Site;
  • To protect and defend the property rights of THCSpots, the Site, or that of THCSpots Site users; or

THCSpots has no control over, nor does it bear any of the responsibility for the privacy policies and/or content of any sites or advertisers linked to or on our Site. THCSpots also takes no responsibility for the cookies these sites or advertisers might deposit on your hard drive.

Safety and Security

Security

To prevent unauthorized access or disclosure, maintain data accuracy and facilitate the appropriate use of information, THCSpots uses physical, technological and administrative procedures to attempt to protect the personally identifiable information we collect through the Site. Nevertheless, Internet transmissions are never completely private or secure. You understand that any messages or information you send to the Site may be read or intercepted by others.

When our registration/order form asks users to enter sensitive information (such as a credit card number), the information you provide is encrypted using SSL. While on a secure page, such as our order form, you will know that you are on a secure page because the lock icon on the bottom of Web browsers such as Microsoft Internet Explorer is in its locked form, as opposed to un-locked, or open, when you are just ‘surfing’. We use a third party credit card processing company to bill users for goods and services. This company does not retain, share, store or use personally identifiable information for any secondary purposes.

While we use SSL encryption to protect sensitive information online, we also take steps to protect all user information off-line. For example, all of our users’ information, not just the sensitive information mentioned above, is subject to restricted use in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) have access to personally identifiable information.

Identification and Passwords

In connection with certain THCSpots programs or services, you may choose, or we may issue to you, a username, password or other similar access code. Certain of our vendors and partners may also issue to you and/or include in their communications with you usernames, passwords and other similar access codes. In order to protect the privacy of your personally identifiable information and to comply with the Terms, you must keep any such username, password or access code secret. You may not disclose your user name, password or access code to any third party, or allow any third party to access your account.

You acknowledge and agree that you are responsible for all actions taken using any username, user ID, login or other identifier (each, an “Identifier”) or password selected by, or issued to, you in connection with the Site, including, without limitation, any fees charged to your account. You agree to notify THCSpots immediately of any unauthorized use of any Identifier or password or any other breach of security of which you are aware by contacting us, and you should immediately change your password. You may not use any Identifier or password that is not issued directly to you by THCSpots or its authorized vendors or partners.

Other Information

Our Retention of Your Personally Identifiable Information

Once registered with the Site, the personally identifiable information that you provide will be stored and maintained by THCSpots until you instruct us otherwise, or, in THCSpots’s sole discretion, for the longer of: (a) for so long as is necessary or appropriate to carry out the purpose(s) for which such information was collected, and (b) for so long as we are required to maintain such information by law.

Choice and Opt-Out Preferences

You may “opt-out” of receiving further information about THCSpots and third party products and services (other than support or other information that you specifically request by filling out the online forms to register or to request online support services) by checking the appropriate boxes on the online and other forms. If you are an advertiser with THCSpots, you may also manage your opt-out and other preferences online via the “My Account” link. If, at any time, you prefer not to receive further e-mail communications from THCSpots, you will have the ability to unsubscribe from such communications by means of a link provided in every broadcast e-mail that is sent to you by THCSpots. If, at any time, you prefer not to receive any other form of communication from THCSpots, you will have the ability to unsubscribe from such communications by e-mailing us. However, you will not be able to unsubscribe from e-mail and other communications that contain mandatory account-related information and required notifications.

Access and Accuracy

THCSpots aims to keep your personally identifiable information as accurate as possible. You will have the opportunity to update and correct any of your personally identifiable information collected and maintained by THCSpots by logging into the Site and entering any new information about yourself. You must promptly update your personally identifiable information if it changes or it is not accurate. You may change your password, email address and other contact information, financial and shipping information and user preferences by logging into the Site and selecting the appropriate options from our menus. As a general policy, THCSpots will not be required to modify your personally identifiable information upon request, although THCSpots reserves the right to access, remove or modify such information in its sole discretion. Special Notice to California Residents

Under California Law SB 27, California residents have the right to receive, once a year, information about third parties with whom we have shared personally identifiable information about you or your family for their marketing purposes during the previous calendar year, and a description of the categories of personally identifiable information shared.
